A. Purpose. This policy describes the University's reporting, investigation, and training requirements in compliance with the Stop Campus Hazing Act and the Jeanne Clery Campus Safety Act.
B. Scope. This policy applies to all University of Idaho faculty, staff, students, and student organizations.
C. Definitions. For purposes of reporting statistics on hazing incidents, the following definitions apply.
C-1. Hazing. Any intentional, knowing, or reckless act committed by a person (whether individually or in concert with other persons) against another person or persons regardless of the willingness of such other person or persons to participate, that
a. is committed in the course of an initiation into, an affiliation with, or the maintenance of membership in, a student organization (e.g., a club, athletic team, fraternity, or sorority); and
b. causes or creates a risk, above the reasonable risk encountered in the course of participation in the University of Idaho or the organization, of physical or psychological injury.
Hazing does not include customary athletic or cultural events or other similar contests or competitions.
C-2. Student Organization. An organization at an institution of higher education (such as a club, society, association, varsity or junior varsity athletic team, club sports team, fraternity, sorority, band, or student government) in which two or more of the members are students enrolled at the institution of higher education, whether or not the organization is established or recognized by the institution.
D. Policy
D-1. In general. It is the policy of the University of Idaho to comply with the Stop Campus Hazing Act, the Jeanne Clery Campus Safety Act, and Idaho Code §18-917 Hazing.
D-2. Hazing reporting obligations; report and investigation process
a. All hazing incidents must be reported to a Campus Security Authority as required by the Jeanne Clery Campus Safety Act. All Clery Act crimes can be reported here.
b. By enrolling at the University of Idaho, students voluntarily accept responsibility for compliance with all university policies, including FSH 2300 Student Code of Conduct and FSH 2320 Student Organization Code of Conduct, as well as local ordinances and state and federal laws, Each student is responsible for their conduct from the time the university grants admission through the actual awarding of a degree.
c. To report a hazing concern, use the VandalCARE referral form and select "Conduct Referral." This reporting form is monitored by the Dean of Students Office during regular business hours. If this is an immediate concern, please contact Vandal Security at 208-885-7233 or Moscow Police Department at 208-882-2677.
D-3. Hazing prevention and awareness programs
a. Training. The U of I's campus-wide hazing prevention and awareness programs are based on research-informed strategies and educate learners on:
- Recognizing, preventing, and reporting hazing.
- Understanding the impact of hazing on individuals and communities.
- Fostering safer and healthier group dynamics.
b. Student participation requirements. All new undergraduate students, including transfer students, are required to complete required training on hazing prevention. This course is part of the required safety program and must be completed by the second week of classes during their first semester at the University.
c. Employee participation requirements. All University of Idaho employees are required to complete required training on hazing prevention annually. This training ensures that employees understand their roles in preventing hazing and supporting a safer campus environment.
D-4. Documentation/hazing transparency report. In accordance with the Stop Campus Hazing Act, the University of Idaho will maintain and publicly report findings of hazing violations by any student organization. The hazing transparency report will include any violations of the Organizational Code of Conduct or state or federal laws relating to hazing. Reports of hazing that did not result in a finding of responsibility are not included. The University will update this information at least ten calendar days prior to the start of each fall and spring semester (i.e. twice each year) and within 14 days of a finding of responsibility for hazing behavior. We will maintain the report for seven years. Any student organization under active investigation will not appear on the Hazing Transparency Report.
The report will include the following information:
- The name of the student organization.
- The date the investigation was initiated.
- The date on which the investigation ended with a finding that a violation occurred.
- A description of the incident or incidents, including the date of the initial violation, and the violations, findings, and sanctions placed on the student organization.
- The details of the sanction or sanctions imposed, including the beginning and end dates of the sanction or sanctions.
- The date the student organization was charged with a violation.
