Even before the polls closed Nov. 3, President Donald Trump’s campaign filed lawsuits challenging the acceptance of absentee and early votes, as well as asking that vote counting be stopped. Now, Attorney General William Barr has allowed U.S. attorneys to “pursue substantial allegations” of voter fraud before the results of the 2020 presidential election are certified. This panel of legal experts will examine election law in pivotal states and assess the merits of ongoing challenges to the voting process and results. Read more

On May 8, Professor Macfarlane participated in a workshop hosted by Boston University School of Law organized in connection with the forthcoming book “A Critical Guide to Civil Procedure.” Macfarlane’s chapter describes the federal civil procedure applicable only to prisoner civil rights and habeas litigation. The annual ABA Water Law Conference brings water law experts and practitioners from all over the US to discuss the latest issues/disputes in water law. This panel covered a case of first impression before the Nevada Supreme Court on certification from the Ninth Circuit on whether, under Nevada law, the public trust doctrine requires the State’s water administrative agency to curtail the exercise of existing water rights to protect a public trust resource and whether doing so would constitute a taking.
