Area of City Impact Agreements in Idaho (2012)

In Fall, 2012, research by the Clinic on behalf of specific clients interested in renegotiating an area of city impact agreement (“AOI Agreement”) led to a substantial knowledge about such agreements that, it became clear, was of general interest to cities and counties throughout the State of Idaho. AOI Agreements are required by Idaho Code section 67-6526 “to delineate areas of future contiguous growth in order to assure their orderly development and thereby reconcile potentially competing designs for boundary expansion with accepted land use planning principals.” City of Garden City v. City of Boise, 104 Idaho 512, 514, 660 P.2d 1355, 1357 (1983).

Working with a statewide coalition researching AOI Agreements, the Clinic drafted Area of City Impact Agreements in Idaho to freely share what it had learned. The report is available for download below.
